Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the AutoCamera AI-powered product photo editing service ("Service") provided by AutoCamera ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Definitions

1. "Service" means the AI-powered product photo background removal and style application service provided by the Company.
2. "User" means any individual who uses the Service in accordance with these Terms.
3. "Guest" means a User who uses the Service without creating an account, identified by device identifier.
4. "Member" means a User who uses the Service by signing in with an Apple or Google account.
5. "Content" means images uploaded by Users and output generated through the Service.
6. "Processing Style" means the styles applied during AI processing, including Store, Instagram, Story, and Luxury.

3. Modifications to Terms

1. These Terms become effective when posted within the Service or otherwise communicated to Users.
2. We may modify these Terms from time to time in compliance with applicable laws.
3. We will notify Users of any material changes at least 7 days before they take effect. For changes that are unfavorable to Users, we will provide 30 days' notice.
4. If you do not agree to the modified Terms, you may discontinue use of the Service and delete your account.

4. Service Description

1. The Company provides the following services:
   • AI-powered product photo background removal
   • Application of 4 styles (Store, Instagram, Story, Luxury)
   • Download and sharing of processed images
   • Batch processing (processing multiple images at once)
   • Other services as determined by the Company
2. The Service is generally available 24 hours a day, 7 days a week, but may be temporarily unavailable for system maintenance.
3. The Company may modify the Service to improve quality, with prior notice to Users.

5. Usage Fees and Quotas

1. Guest Users receive a daily free quota of 5 processing requests.
2. Free Members receive a daily free quota of 10 processing requests.
3. Premium Members receive additional quota according to their subscription plan.
4. Daily quotas reset at midnight (KST/UTC+9).
5. Pricing and payment terms for paid services are displayed separately within the Service.

6. User Obligations

Users must not engage in the following activities:

1. Copyright Infringement: Uploading images that infringe on copyrights, trademarks, or other intellectual property rights of others
2. Illegal Content: Uploading pornographic, violent, or hateful content
3. Privacy Violations: Uploading images that violate the privacy or publicity rights of others
4. Service Abuse: Using automated means for bulk processing requests or other misuse of the Service
5. System Interference: Actions that overload servers or interfere with the normal operation of the Service
6. Fraudulent Use: Creating multiple accounts to circumvent quota limitations
7. Other: Actions that violate applicable laws or public morals

7. Content Rights

1. Original Images: All rights to original images uploaded by Users remain with the Users.
2. Processed Results: Users are granted the right to use the processed output images generated through the Service.
3. License Grant: Users grant the Company a limited license to process Content solely for the purpose of providing the Service.
4. No AI Training: We do not use your images to train AI models.
5. Deletion: Uploaded images are automatically deleted within 24 hours after processing is complete.

8. Service Restrictions

1. The Company may restrict Service access if a User violates the obligations in Section 6:
   • Warning: Request to cease the violating behavior
   • Temporary Suspension: Suspension of Service access for a specified period
   • Permanent Ban: Permanent restriction of Service access and account deletion
2. The Company will notify the User of the reason and duration of any restriction.
3. Users may dispute restrictions, and the Company will review and respond accordingly.

9. Disclaimers

1. Force Majeure: The Company is not liable for service interruptions due to natural disasters, war, telecommunications carrier service disruptions, or other force majeure events.
2. User Fault: The Company is not liable for service issues caused by the User's own actions.
3. AI Output: Due to the nature of AI technology, we do not guarantee the perfection of processed results. Users are responsible for their use of the output.
4. Third-Party Disputes: The Company is not liable for disputes with third parties arising from Content uploaded by Users.
5. Indirect Damages: The Company is not liable for indirect damages such as loss of expected profits from using the Service.

10. Termination and Refunds

1. Users may discontinue use of the Service and delete their account at any time.
2. Refunds for paid services are handled in accordance with applicable laws and the Company's refund policy.
3. Upon account deletion, related data will be processed in accordance with our Privacy Policy.

11. Dispute Resolution

1. Disputes between the Company and Users shall be resolved through mutual consultation.
2. If consultation fails, disputes shall be resolved through procedures prescribed by applicable laws.
3. These Terms shall be governed by the laws of the Republic of Korea, and disputes shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Company's headquarters.

12. General Provisions

1. Matters not specified in these Terms shall be governed by applicable laws and commercial practices.
2. If any provision of these Terms is found to be invalid, the remaining provisions shall remain in effect.
